學英文不會輕易放棄秘密心聲
柯姓民眾撿到一銀贓款，是拾金不昧？還是侵占遣失物。律師胡原龍表示，柯姓民眾在撿到16小時後才送到警局，其行為雖有道德爭議，但基於刑法「罪疑唯輕」原則，民眾在未被發現前，主動交出，難以構成犯罪。
胡原龍說，侵占遺失物罪，主觀上必須要不法所有，客觀要件則如在警方或遺失人尚未發現前主動繳回，難推定有不法意圖。
他解釋，只要沒被發覺，不管事隔多久，主動「物歸原主」，就難以刑法相繩，而若不知是贓款，也就是無主的遺失物，拾得人沒有侵占不法意圖，還可依民法向物主請求1/10的報酬。
